Payment Policy

Optimal was created with the intention of helping companies optimize their operations and grow better every day. Our mission to increase productivity and improve the results of companies is reflected not only in the solutions we develop but also in the services and the way we relate to our customers and partners.

We know that predictability and cost efficiency are essential for maintaining competitiveness and, more importantly, for creating growth strategies that drive their businesses even further. By focusing on the success of companies and the quality of our product, we enhance the customer experience and make our products better and more accessible.

With the aim of being as transparent as possible with those considering hiring our paid services, we have created this Payment Policy, which aims to:

i. Present the plans and versions of the program currently offered, as well as the payment rules for each hiring format;

ii. Present policies for adding new services or upgrading the account during the contract;

iii. Describe the cancellation process of the contracts.

This Payment Policy applies to all plans offered, whose information and details are specified on the Pricing page on the Optimal website: https://optimal.com.br/en/plans-prices, each with its particularity regarding functionalities, availability of records, and the number of users to be registered.

 

Offered Plans and Renewals

Except for single-payment products and services, such as training, customizations, and integration development, all cloud-based products offered by Optimal are marketed in two cycles:

a. Monthly hiring, with monthly payments;

b. Annual hiring, with payment:

b.i. In a single installment; or,

b.ii. In 12 (twelve) installments.

Additionally, we offer two Plans for Formulamix: Growth and Pro. Prices and differences between them are detailed on the page https://optimal.com.br/en/plans-prices. Each Plan has a maximum limit of user and Organizational Unit registrations. You can track the number of Users in the Users tab of your account. Also, you can track the number of Organizational Units in the tab of the same name. You can increase your limit at any time, respecting the payment rules proportionately if it is in the middle of a current subscription.

 

Payment and Taxes

In monthly hiring, the payment of monthly fees is made automatically: (i) by monthly deduction of the value of the respective plan on the credit card statement registered in our platform by the customer; (ii) by bank transfer (PIX); or (iii) through a bank slip issued by Optimal. Regarding this hiring format:

i. Monthly hiring presupposes the provision of services for a period of 1 (one) month;

ii. The contract will automatically renew in the following month, so that the interruption of payment will result in the automatic termination of the contract from the day immediately following the due date of the unpaid installment, without any cost or penalty for either party;

iii. If you have opted for payment via bank transfer (PIX) or bank slip, billing and sending the respective Invoice will occur on the first or second business day of the month, and the corresponding payment must be made by the 10th (tenth) of the same month, under penalty of automatic termination of the contract, without any cost or penalty for either party.

In annual hiring, with a single payment, the full amount of the hiring must be made by bank transfer (PIX), by automatic credit card deduction, or by bank slip, at your discretion. In annual hiring, with payment in 12 (twelve) installments, the full amount of the hiring will be due even if the contract is terminated before its term, and must be made by automatic credit card deduction or by bank slip, at your discretion. Regarding this hiring format:

i. Annual hiring presupposes the provision of services for a period of 12 (twelve) months, and the corresponding price is equivalent to the sum of 12 (twelve) monthly installments of the chosen Plan, reduced by an exclusive discount granted by Optimal due to your choice of the annual contract;

ii. No amount will be refunded by Optimal if you choose to terminate the contract before the end of the 12 (twelve) month period. In this case, if the hiring is annual with payment in 12 (twelve) monthly installments, the future installments will become due in advance on the date of contract termination and must be paid in a single installment within 5 (five) business days from the date of formalization of said termination.

In cases of payment by credit card deduction (whether in monthly and/or annual hiring), if the card is canceled or the automatic transaction is obstructed for any reason, you can update the payment details and regularize the hiring on the Optimal website, navigating in the “Settings” area or by contacting the Optimal team at support@optimal.com.br.

In case of non-payment of any invoice for contracted services, regardless of prior notice, Optimal may suspend your access to the System, preventing new inclusions in the platform. However, scheduled actions before said suspension will continue to be performed based on activities carried out until the date of suspension. Unpaid amounts on their respective due dates will be subject to a fine of 2% (two percent) and interest of 1% (one percent) per month.

Foreign clients (based outside Brazil) may make payments by credit card or via wire transfer exclusively when the total amount of the subscription exceeds US$ 2,000.00 (two thousand US dollars) by the rate on the date of hiring.

Optimal may, at its discretion, as a mere liberality, grant discounts on plan values, which will be valid for up to 12 (twelve) months. Optimal may also renew or not existing discount percentages or cancel discounts after the expiration period without prior notice. Plan values may be updated annually according to the current plans and pricing table at the time of the update, which will be available in your Settings area. If this occurs, you will be notified at least 15 (fifteen) calendar days in advance.

By choosing the desired plan and contact package, you will pay the amount according to the current price list at the time of hiring. If you change your plan (upgrading or migrating to another plan), the charged amount will be the one available in the price list at the time of the change.

The prices and values charged for our services and products exclude taxes on them in the jurisdiction in which the respective payment is made or received, and such taxes will be entirely and exclusively borne by you, even if the legal taxpayer is Optimal.

 

Automatic Renewal

As a rule, contracts (annual and monthly) will be automatically renewed for periods equal to those originally contracted, and the renewed contract will be subject to prices and values in force at the time of billing, according to the price list available on the Optimal website.

 

Automatic Cancellation of Contract

The cancellation of the credit card registered on the platform or the hindrance to the discount of the plan’s hiring amount will not prevent the billing of the respective price of the contracted service. If billing cannot be done through the registered card, you will have up to 5 (five) business days to update the payment details. If not done, services will be interrupted until the 30th (thirtieth) day after the invoice was created – in this scenario, no user registered in the tool will be able to access the program, and their information will be stored (for a period of 30 [thirty] consecutive days), in case you wish to resume usage during that time.

Exclusively in cases of monthly hiring, if the payment of the monthly fee is not identified within 30 (thirty) consecutive days from the due date, the respective contract will be automatically canceled. The reactivation of the monthly contract can be done by sending an email to the address: support@optimal.com.br, upon settling any debts contracted with Optimal previously, and anticipating the value of the new plan to be hired (whether monthly or annually). Your registration and access data entered into Optimal systems for hiring any plan will be entirely deleted after 60 (sixty) consecutive days from the cancellation date.

 

Plan Increasing Throughout the Contract

In monthly hiring, you can change the plan or the quantity of samples and users originally contracted at any time. The value of the difference corresponding to the respective change will be charged proportionally to the number of days that may be missing to complete the month of the original hiring, and you will have the new plan/feature available from the date of said change. In the following month, the billing and the functionalities newly enabled by you will be automatically updated in your account so that future renewals occur from the new plan/feature contracted.

In annual hiring, you can also change the plan or the quantity of samples and users originally contracted at any time. In this case, the value of the difference corresponding to the respective change will be charged proportionally to the number of months that may be missing to complete the period of the original hiring (one year), and you will have the new plan/feature available from the date of said change.

Increases in samples and users are sold separately, and the respective monthly fee will be applied according to the term of your contract. For example, if you want to increase the number of samples in your Growth Plan with 7 (seven) months remaining until the end of your annual contract, you will be charged for the increment multiplied by 4 (four), which corresponds to the number of months needed to complete the original 12-month contract cycle. Thus, the new quantity of samples available for registration would be applied until the end of your current contract.

Consider another example: on September 1, 2023, the customer acquired the Formulamix Growth Plan, through annual hiring, and paid R$ 6,828.00. This hiring would expire on August 31, 2024. However, in January 2024 (any day of the month), the customer decided to migrate the hiring to the Pro Plan, still in the annual mode, which, in theory, would cost him R$ 14,408.00. In this case, the amount to be paid for the contracted increment would be: 1/12 (one twelfth) of the difference between the plan values, multiplied by the number of months remaining to complete the original contract cycle. In this example, as the difference would be R$ 7,980.00 (= R$ 14,408.00 – R$ 6,828.00) and there were 6 (six) months left until the end of the original contract, the amount to be paid by the customer as a complement for the plan migration would be R$ 3,990.00 (= [1/12 x R$ 7,980] x 6).

 

Migration to a Lower Monthly Plan and Voluntary Cancellation

If your subscription is monthly, you can migrate to a plan lower than the one originally contracted. To do so, you must access the Settings area and inform Optimal of your choice at suporte@optimal.com.br, requesting the migration to the desired plan, with a notice of up to 20 (twenty) consecutive days from the next billing date. In this case, the next monthly fee will be updated to the price of the new plan chosen by you.

The annual hiring option will not allow migration to lower plans, as you will not be reimbursed by Optimal for the amount paid as an annual fee for the plans under any circumstances.

Both monthly and annual subscriptions can be canceled at any time. To do this, you must access the system’s Settings area and disable the automatic renewal of your plan or send an email to suporte@optimal.com.br, requesting cancellation, with notice of up to 20 (twenty) consecutive days from the next billing date. The indication of the cancellation option (via the system or by email) is not mandatory (as it does not incur penalties), but it prevents the undesired renewal of the contract and the consequent automatic billing of the corresponding price for the following period (month or year). In this case, Optimal will ensure access to the system, in the contracted mode, until the end of the originally contracted period but will not reimburse amounts paid by you, regardless of the subscription format.

 

General Conditions

By subscribing to the plans covered by this Payment Policy, you agree:

i. to give Optimal 30 (thirty) days to attempt to resolve any billing-related issues before disputing with credit card companies or third-party banks;

ii. that Optimal may send any contested amounts to a collection agency;

iii. that the prices of any and all subscriptions, products, and/or services from Optimal will not be refunded under any circumstances.

Our invoices and tax invoices are provided via email. To facilitate communication between the parties, you agree that Optimal may use all contact channels registered in its databases to contact you, such as phone or instant messaging apps.

Optimal may change any of the provisions of this Payment Policy at any time. In this case, you will be notified of the document update. For more information, you can send an email to our team or contact our support team through the suporte@optimal.com.br channel.
