Payment Policy

Optimal was founded with the aim of assisting companies in optimizing their operations and growing more effectively each day. Our mission to enhance productivity and improve business results is reflected not only in the solutions we develop but also in the services and how we engage with our customers and partners.

We understand that predictability and cost efficiency are crucial for maintaining competitiveness and, more importantly, for creating growth strategies that propel businesses even further. By focusing on the success of companies and the quality of our product, we enhance the customer experience and make our products better and more accessible.

To be as transparent as possible with those considering our paid services, we have created this Payment Policy with the following objectives:

i. Present the plans and versions of the program currently offered, as well as the payment rules for each hiring format.

ii. Present the policies for adding new services or upgrading the account during the hiring process.

iii. Describe the cancellation process for hires.

This Payment Policy applies to all plans offered, with information and details outlined on the Optimal Pricing page: [https://optimal.com.br/en/plans-prices], each with its specifics regarding functionalities, the quantity of available samples, and the number of users to be registered.

 

Offered Plans and Renewals

Except for one-time payment products and services, such as training, customizations, and integration development, all cloud-based products offered by Optimal are marketed in two cycles:

a. Monthly hiring, with monthly payments.

b. Annual hiring, with payment:

   b.i. In a single installment; or,

   b.ii. In 12 (twelve) installments.

Additionally, we offer two plans for Labinfy: Growth and Pro. Prices and differences between them are detailed on the [https://optimal.com.br/en/plans-prices] page. Each Plan comes with a maximum limit of new sample registrations per month. You can track the quantity of samples for the current month in the Sample Management tab of your account. Additionally, the sample quantity is not cumulative from month to month, and deleting created samples will not free up space for new registrations. You can increase your limit at any time, respecting the payment rules if it is in the middle of a current subscription.

 

Payment and Taxes

In the monthly subscription, the payment of installments is done automatically: (i) through the monthly deduction of the respective plan’s amount on the credit card statement registered on our platform by the customer; (ii) through bank transfer (PIX); or (iii) via bank slip issued by Optimal. Regarding this hiring format, it is worth clarifying that:

i. Monthly subscription implies the provision of services for a period of 1 (one) month;

ii. The contract will renew automatically the following month, so the interruption of payment will result in the automatic termination of the contract from the day immediately following the due date of the unpaid installment, without costs and/or penalties for any of the parties;

iii. If you have opted for payment via bank transfer (PIX) or bank slip, billing and sending the respective invoice will occur on the first or second business day of the month, and the corresponding payment must be made by the 10th (tenth) of the same month, under penalty of automatic termination of the contract, without costs and/or penalties for any of the parties.

In the annual subscription, with a one-time payment, the full value of the subscription must be made through bank transfer (PIX), automatic credit card deduction, or bank slip, at your discretion. In the annual subscription, with payment in 12 (twelve) installments, the full value of the subscription will be due even if the contract is terminated before its end, and it must be paid through automatic credit card deduction or bank slip, at your discretion. Regarding this hiring format, it is worth clarifying that:

i. Annual subscription presupposes the provision of services for a period of 12 (twelve) months, and the corresponding price is equivalent to the sum of 12 (twelve) monthly payments of the chosen Plan, reduced by an exclusive discount granted by Optimal due to your choice of the annual contract;

ii. No amount will be refunded by Optimal if you choose to terminate the contract before the end of the 12 (twelve) months. In this case, if the subscription is annual with payment in 12 (twelve) monthly installments, the future installments will become due in advance, on the date of the contract termination, and must be paid in a lump sum within 5 (five) business days from the date of formalization of said termination.

In cases of payment through credit card deduction (whether in monthly and/or annual subscription), if the card is canceled or the automatic transaction is obstructed for any reason, you can update the payment details and regularize the subscription on the Optimal website, navigating to the “Settings” area or by contacting the Optimal team via email at support@optimal.com.br.

In case of non-payment of any invoice for contracted services, regardless of prior notice, Optimal may suspend your access to the System, preventing new inclusions on the platform. However, scheduled actions before said suspension will continue to be carried out, based on activities performed until the suspension date. Unpaid amounts on their respective due date will be subject to a fine of 2% (two percent) and interest of 1% (one percent) per month.

Foreign clients (located outside Brazil) can make payments by credit card or via wire transfer exclusively when the total subscription amount exceeds US$ 2,000.00 (two thousand US dollars) by the exchange rate on the date of subscription.

Optimal may, at its discretion and as a mere favor, grant discounts on plan values, which will be valid for up to 12 (twelve) months. Optimal may also renew or not renew existing discount percentages or cancel discounts after the expiration period, without prior notice. Plan values may be updated annually, according to the current plan and price table at the time of the update, which will be available in your Settings area. If this occurs, you will be notified at least 15 (fifteen) calendar days in advance.

By choosing the desired plan and contact package, you will pay the amount according to the current price table at the time of hiring. If you change your plan (upgrading or migrating to another plan), the amount charged will be the one available in the price table at the time of the change.

The prices and values charged for our services and products exclude taxes imposed on them in the jurisdiction where the respective payment is made or received, and these taxes will be entirely and exclusively borne by you, even if the legal taxpayer is Optimal.

 

Automatic Renewal

As a rule, subscriptions (annual and monthly) will be automatically renewed for periods equal to those originally contracted, and the renewed contract will be subject to the prices and values in effect at the time of the charges, according to the price table available on the Optimal website.

 

Automatic Termination of Subscription

Cancellation of the credit card registered on the platform or the prevention of the deduction of the plan’s contracted amount will not prevent the billing of the respective service price. If billing cannot be done through the registered card, you will have up to 5 (five) business days to update the payment details. If not done, services will be interrupted until the 30th (thirtieth) day after the invoice was created – in this scenario, no user registered in the tool will be able to access the program, and their information will be stored (for a period of 30 [thirty] calendar days) in case you want to resume usage during this time.

Exclusively in the case of monthly subscriptions, if the payment of the installment is not identified within 30 (thirty) calendar days from the due date, the respective subscription will be automatically canceled. The reactivation of the monthly subscription can be done by sending an email to the address: support@optimal.com.br, upon settlement of any debts incurred with Optimal previously and the advance payment of the value of the new plan to be contracted (whether monthly or annual). Your registration and access data entered into Optimal systems for the hiring of any plan will be entirely deleted after 60 (sixty) calendar days from the cancellation date.

 

Plan Increasing During Subscription

In the monthly subscription, you can change the plan or the quantity of samples and users originally contracted at any time. The difference amount corresponding to the respective change will be charged proportionally to the number of days remaining until the completion of the original month of the contract. You will have the new plan/feature available from the date of the change. In the following month, the billing and newly enabled features will be automatically updated in your account, so that future renewals occur based on the new plan/feature contracted.

In the annual subscription, you can also change the plan or the quantity of samples and users originally contracted at any time. In this case, the difference amount corresponding to the respective change will be charged proportionally to the number of months remaining until the completion of the original contract period (one year), and you will have the new plan/feature available from the date of the change.

Sample and user increments are sold separately, and the respective monthly fee will be applied according to the term of your contract. For example, if you want to increase the number of samples in your Growth Plan with 7 (seven) months remaining for the expiration of your annual subscription, you will be charged for the increment amount multiplied by 4 (four), which corresponds to the number of months needed to complete the original annual contract cycle, which is 12 (twelve) months. Thus, the new quantity of samples available for registration would be applied until the end of your current subscription.

Consider another example: On September 1, 2023, the customer acquired the Labinfy Growth Plan, with an annual subscription, and paid R$ 5,988.00. This subscription would expire on August 31, 2024. However, in January 2024 (any day of the month), the customer decided to upgrade the subscription to the Pro Plan, still in the annual mode, which, in theory, would cost him R$ 15,588.00. In this case, the amount to be paid for the contracted upgrade would be: 1/12 (one twelfth) of the difference between the plan values, multiplied by the number of months remaining to complete the original contract cycle. In this example, as the difference would be R$ 9,600.00 (= R$ 15,588.00 – R$ 5,988.00), and there would be 6 (six) months left until the end of the original subscription, the amount to be paid by the customer as a supplement for the plan upgrade would be R$ 4,800.00 (= [1/12 x R$ 9,600.00] x 6).

 

Migration to a Lower Monthly Plan and Voluntary Cancellation

If your subscription is monthly, you can migrate to a lower plan than originally contracted. To do so, you must access the Settings area and inform your option to Optimal at the address support@optimal.com.br, requesting migration to the desired plan, with a notice of up to 20 (twenty) calendar days from the date of the next billing. In this case, the next monthly fee will be updated to the price of the new plan chosen by you.

The annual subscription mode will not allow migration to lower plans, as you will not be reimbursed by Optimal for the amount paid for plan annual fees under any circumstances.

Both monthly and annual subscriptions can be canceled at any time. To do so, you must access the system’s Settings area and disable the automatic renewal of your plan or send an email to the address support@optimal.com.br, requesting cancellation, with notice of up to 20 (twenty) calendar days from the date of the next billing. The signaling of the cancellation option (via system or email) is not mandatory (as it does not incur penalties) but prevents the undesired renewal of the contract and the consequent automatic billing of the price corresponding to the next period (month or year). In this case, Optimal will guarantee access to the system, in the contracted mode, until the end of the originally contracted period, but will not refund amounts paid by you, regardless of the subscription format.

 

General Conditions

By subscribing to the plans covered by this Payment Policy, you agree:

i. to grant Optimal 30 (thirty) days to attempt to resolve any billing-related issues before disputing with credit card companies or third-party banks;

ii. that Optimal may send any disputed amounts to a collection agency;

iii. that prices for any and all subscriptions, products, and/or services from Optimal will not be refunded under any circumstances.

Our invoices and tax documents are provided via email. To facilitate communication between the parties, you agree to the possibility of Optimal using all contact channels registered in its databases to reach you, such as phone or instant messaging apps.

Optimal reserves the right to change any provisions of this Payment Policy at any time. In such a case, you will be notified of the document’s update. For more information, you may send an email to our team or contact our support team via the channel support@optimal.com.br.
